# Third-Party Model Terms

The terms below (“**Third-Party Model Terms**”) forms part of, and is subject to, the Master Services Agreement or other written or electronic terms of service or subscription agreement between Lampi AI and Customer that reference this terms (the “**Agreement**”), and is effective on the Effective Date of the Agreement.&#x20;

Capitalized terms used in these Third-Party Model Terms but not defined below are defined in the Agreement.  Lampi AI may modify these Third-Party Model Terms periodically. If an update will materially affect Customer's use of the Lampi AI Software, Lampi AI will notify Customer prior to the update's effective date (except for changes due to legal or regulatory reasons which may be effective immediately). Otherwise, updates will be effective as of the date of deployment.

**Service evolution and modifications.** The Customer acknowledges that Third-Party Models Provider services are subject to technological evolution and policy changes. Lampi AI reserves the right to modify these Terms to reflect significant changes in Third-Party Models Provider services or policies. The Customer explicitly acknowledges that Lampi AI bears no liability for Third-Party Models Provider -initiated changes and cannot guarantee that such changes will not impact Lampi AI's Services.

**Data processing and privacy.**&#x20;

**a. Customer Data Processing**: Customer authorizes Lampi AI to transmit Customer Data, including Personal Information, to Third-Party Model Provider in accordance with the Data Processing Agreement and service functionality requirements. DPA agreements with each Third-Party Model Provider can be found in the [Sub-Processors ](/sub-processors-notice.md)Notice.

**b. Model Training Restrictions**:&#x20;

**i. Lampi AI and Third-Party Models Providers are prohibited from using Customer Data for model training**&#x20;

ii. Lampi AI is not allowed to grant third parties rights to use Customer Data for model training&#x20;

iii. Customer's use of Lampi AI's Services does not confer any rights to use Customer Data for training purposes.

**c. Data Retention from FMP:**

**i. All selected Third-Party Models Providers apply a “Zero Data Retention” policy,** meaning that Customer Content will not be logged for human review and will not be saved to disk or retained by those providers.&#x20;

**d. Model Provider Selection**

Customers have the ability to opt out of any Third-Party Models available for inference (directly through the user interface).

**User Responsibilities**: Customer maintains sole responsibility for:&#x20;

i. Input and Output usage compliance with applicable laws&#x20;

ii. Adherence to these Terms, the Agreement, and

iii. Respecting intellectual property rights.

When using Third-Party Models, Customer must comply with all applicable Third-Party Model Provider policies.

Lampi AI explicitly disclaims all warranties regarding:&#x20;

i. Results obtained through service use&#x20;

ii. Third-Party Model Output accuracy.

**Risk Acknowledgment:** i. Service use and Output utilization occur at Customer's sole risk&#x20;

ii. Users must independently verify Output accuracy

iii. Detailed or specific Output may contain inaccuracies&#x20;

iv. Outputs may not reflect post-training developments

c. No oral or written information provided by Lampi AI creates additional warranties beyond those expressly stated herein.
